1. Acceptance of Terms
By accessing or using the CrispForms website (crispforms.com) or our application — available at form.crispforms.com (and our legacy application at app.crispforms.com for existing users) — together with all forms, integrations, and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Service. These Terms constitute a legally binding agreement between you and CrispForms.
2. Description of Service
CrispForms is a platform for creating, publishing, and managing single-page and conversational forms, surveys, and quizzes. Beyond form building, the Service includes a built-in CRM (contacts), a calendar and appointment bookings, payment collection and a product catalog with checkout, analytics, email automation, and integrations with third-party services. A Free tier offers core features, and paid plans (Pro, Growth, and Scale) add higher limits and advanced functionality. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
3. Eligibility & Accounts
To use certain features, you must create an account. You agree to: (a) provide accurate, current, and complete information; (b) keep your account information up to date; (c) maintain the security of your credentials and accept responsibility for all activity under your account; and (d) notify us immediately of any unauthorized use. You must be at least 18 years of age or the age of legal majority in your jurisdiction. Workspaces let you separate forms, contacts, billing, and team members; you are responsible for the members you invite and the roles you assign.
4. Plans, Limits & Billing
The Service is offered through Free, Pro, Growth, and Scale plans, billed monthly or annually per workspace. Each plan includes a monthly response allowance and other limits described at the time of purchase. When a workspace reaches its monthly response limit, its forms pause accepting new responses until the next billing cycle or an upgrade; your existing data remains available. You may upgrade or downgrade at any time.
For paid plans, you authorize us to charge the applicable fees in advance for each subscription period through our payment processor. Subscription fees are non-refundable except as required by law or as expressly stated. For monthly subscriptions, you may cancel anytime and cancellation takes effect at the end of the current period. For annual plans, refunds are handled case by case — contact us for assistance. Features, limits, and pricing may change, and we will provide reasonable advance notice of material pricing changes.
5. Payments You Collect & Products You Sell
The Service lets you collect payments and sell digital or physical products through your forms. These payments are processed through your own Stripe or PayPal account; the funds go directly to you, and CrispForms does not take a commission on them. You — not CrispForms — are the merchant and seller of record for these transactions.
You are solely responsible for the products and services you sell, including fulfillment, delivery (including any digital download links generated by the Service), descriptions, pricing, taxes, refunds, chargebacks, and compliance with applicable laws and the terms of your payment processor. CrispForms is not a party to transactions between you and your customers and is not liable for them. You agree to honor your stated refund and delivery commitments to your customers.
6. Third-Party Services & Google Connections
The Service can connect to third-party accounts you control — such as Google (Gmail, Calendar, Sheets), Stripe, PayPal, Airtable, Slack, Discord, Microsoft Teams, Zapier, Make.com, HubSpot, and Mailchimp. You authorize each connection and may revoke it at any time. Your use of those services is governed by their own terms, and you are responsible for complying with them. Our access to and use of data from Google APIs is described in our Privacy Policy and adheres to the Google API Services User Data Policy, including its Limited Use requirements. We are not responsible for the availability, accuracy, or practices of third-party services.
7. Intellectual Property
CrispForms and its licensors own all rights, title, and interest in the Service, including the software, design, trademarks, and content (excluding User Content). You may not copy, modify, distribute, sell, or create derivative works of the Service without our prior written consent. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose, subject to these Terms.
8. User Content & Data Protection
"User Content" means anything you create, upload, or collect through the Service, including forms, questions, responses, contacts, bookings, uploaded files, and recordings. You retain ownership of your User Content. You grant CrispForms a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely to provide and improve the Service.
With respect to data you collect from your respondents and customers, you act as the data controller and CrispForms acts as your processor. You represent that you have all necessary rights and consents, that your forms and data practices comply with applicable laws (including data protection and anti-spam laws), and that your User Content does not infringe third-party rights. You are solely responsible for obtaining any consents required from your respondents.
9. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Spam, phish, or engage in deceptive or fraudulent practices
- Collect personal information without proper consent or a lawful basis
- Sell illegal, infringing, or prohibited goods or services
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to the Service or other users' accounts or data
- Reverse engineer, decompile, or disassemble the Service
- Interfere with or disrupt the Service or its infrastructure, or circumvent usage limits
We may suspend or terminate accounts that violate these prohibitions.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements.
11. Limitation of Liability
To the maximum extent permitted by law, CrispForms and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service or from transactions between you and your customers.
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100). Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
12. Termination
You may terminate your account at any time through account settings or by contacting us. We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service.
14. Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.
